Values as established by the US Constitution |
"I consider
trial by jury as the only anchor yet devised by man, by which a
government can be held to the principles of its constitution."
-- Thomas Jefferson
(1743-1826), US Founding Father, drafted the Declaration of
Independence, 3rd US President, Source: 1789 in correspondence to Thomas
Paine

Self-evident. The function of the Judicial Branch is
to enforce the law. The law is to be self-evident.
Judges have no business interpreting the law. It is the jurors who
should interpret the law according to the values of the jurors, our
peers. The Judge's role is to guide and enforce the decision of
the jurors, not to dictate the laws definition. If the law is so
vague that Judges must interpret and direct it's meaning or
intent, then that law needs to be returned to the Legislative branch of
government for clarification.
(Correction: "The function of the
Judicial Branch is to enforce the law." I'm told I'm incorrect on
this. The function of the Executive branch is to enforce the law.
I'll keep note of this for future writings on my part.)
Real government is about value-based solutions, not whether someone is a
Democrat, a Republican or an Independent. What matters is whether
people in public office will pursue real solutions to real problems
while adhering to the values of the American people. As the values
of the people change, so will the values of the jurors, our peers,
change. The three branches of the American government revolve in
an endless circle. None of the branches constitute an end.
-
The representatives of congress (legislative
branch) are established via the
vote of we, the people, with the interests and values of each
respective state.
The congress then develops laws according to the needs and values of the
states which comprise this Union.
-
The president and his staff (executive
branch) guide and accept or reject the findings of the
legislative branch.
-
The judges (judicial branch)
enforce the Constitution as interpreted by the
jurors, members of the electorate's peers.

NOTE: The above comprises
what I believe should be self-evident about the
US Constitution and how it should be enforced. The
realities of our judicial system currently act contrary to my
beliefs. Judges interpret the Constitution without consideration of the values of 'We, the People'.
The judges currently act on the
premise that 'We, the People' should not be allowed to
direct and establish the 'values' of the US
Constitution. Appointment of Judges |
